sutton served for three terms in congress. the two districts have been redrawn and the two candidates are buying for the single seat that will be ohio's 16th district in the 113th congress congress beginning next january. both are incumbents there are many folks who had an opportunity to vote vice president heard from you. our hope is after the exercise, votes will have a clear understanding of where each of you stands and can cast an informed vote. that's not to say folks haven't heard a lot about it you. as they reported yesterday on cleveland.com the race has been one of the highest draws with outside spending $4.4 million by groups essentially to run attack ads of each of the candidates. set your dvr because a couple of million is on the way. it's refreshing to hear from not just about the represents. two keywords i hope you keep in mind, specifics and contrasts. and if you can be civic in your answers and draw contrast to your opponent. we'll have accomplished our goal of enlightment today. let me set the ground rules quickly. the rules for the opening portion of the debate are e

sutton principle. willie sutton was a bank robber and was once asked why he robbed banks, and he says, "well, that's because that's where the money is." in the same instance, the wells go in near the river because that's where the water is. but, of course, the ground-water pumping interferes with the surface-water systems. it essentially depletes surface water, and you end up with a conflict. this is a very, very limited quantity of water that you are essentially adding a lot more straws into. and ultimately what happens is you run out of water. narrator: pumping a well that's near a stream creates a cone of depression that draws in water from the stream or intercepts water that would have arrived at the stream. as the demand on ground water increases, the level of surface water in streams and rivers decreases. a stream that was once gaining water from aquifers becomes a losing stream until it loses all of its water. dr. maddock: it's a physical problem in terms of the fact that you're taking water out of the stream. it's an ecological problem in the fact that you're reducing habitat

's a frightening statement. but it reminds me of the famous willie sutton bank robber question, why are you robbing banks? because that's where the money. this is going to be an analyst beatdown in terms of the banks. you showed brian moynahan talking about legal lawsuits are a part of doing business. sadly, more than ever for the banks. we spoke to bank of america today. they think the case is meritless based on the fact that five of the issues at point are -- have been settled. one of them is not worth pursuing. the other one -- basically, that leaves one of seven claims questionable. so it's just -- you know, i think this is going to continue. how many of these claims have actually merit and legs will be determined. i don't think this is unique to bank of america because it's so n huge in the mortgage space. countrywide has been accused of doing less than ethical things in the past. everyone with mortgage exposure should be prepared. >> so this is going to become common place then. the lawsuits are there piling up. is it going to impact the stocks? >> i think it's just an overhang for the stocks
